Saliva to cop's face earns felony charge for city man Date published: 1/23/2008
BY KEITH EPPS A Fredericksburg man was charged with a felony Saturday after he spit in the face of a police officer who had arrested him for being drunk in public, police said. According to city police spokeswoman Natatia Bledsoe, the officer went to Roses in Park and Shop Shopping Center about 4:30 p.m. Saturday in response to a complaint about a drunken man causing a disturbance. When police arrived, the man was sitting on a bench outside the store obviously intoxicated, she said. Phillip T. Jurgins, 60, was charged with being drunk in public and taken to the Rappahannock Regional Jail. However, Bledsoe said, the jail wouldn't take Jurgins because he was unable to walk on his own. So police took him to the emergency room at Mary Washington Hospital to be examined. Bledsoe said Jurgins was able to walk into the hospital. Police said the man was disruptive in the hospital and at one point spit in the officer's face. That led to him being taken back to a magistrate's office, where he was charged with assault on a police officer, a felony. Jurgins was also charged with obstruction of justice and disorderly conduct. This time, he was placed in the jail under a $3,000 bond. According to court records, Jurgins has four prior drunk in public convictions in the city, including three last year. I never said it was okay for the guy to spit on the officer. Read EVERYTHING before you respond.
so if Citizen A spits on Citizen B, Citizen B can go the magistrate and get a warrant for assault. In order for police to obtain a warrant for a simple assault between citizens, the assault had to have occurred in the officer's presence. HOWEVER, any type of assault on a police officer is a felony, whether it is spitting, hitting, kicking, etc.
So because the police officer can't acquire AIDS through saliva, it's ok to spit on him. The officer was just doing his job. Do any of you want to be spit on while doing your job. I would guess not. It was a stupid decision on the part of the accused and now he should pay.

Spit doesn't kill anyone...Spitters do. Or something like that.
I find it interesting that this a felony and leaving a loaded firearm out for a 4 year old to take school is a misdemeanor.
