N.Y. trial is a mistake
Can someone please explain the recent decision by Attorney General Eric Holder to try Khalid Sheikh Mohammed and others in federal court as civilians? ["New York, again," Nov. 18].
I don't see how the prosecution could ever get a conviction in this case, or at least one that won't be overturned in an appeal.
Mohammed wasn't "Mirandized," and he didn't have a lawyer present for questioning.
The jury will not be that of his peers, considering he is not a citizen, and a venue in New York should certainly prove to be biased.
Is the government prepared to reveal to the defense the method in which they obtained information or compromise their sources?
Aside from the trial itself, how can we currently justify the war on terror if these men have been innocent until proven guilty this entire time? Do we bomb the neighborhoods and shoot relatives of our accused murderers while they are in jail waiting for their civilian trials?
What about the added security measures that will need to be taken in New York? Sen. Charles Schumer is requesting $75 million for such measures, which would be unnecessary through a military tribunal in Guantanamo.
It is too easy for the defense to find mistakes and flaws in the investigation, arrest, and interrogation of these men.
As an American, I am appalled at the idea that our president is allowing and standing behind this risk. For what benefit?

then let's release him. Your alternative is a crime, just as committed in the nations I mentioned. Do you admire their justice systems? Would you care to be judged in such a rigged process? KSM was handed over to us, our military was never involved. The crime of terrorism targets civilians. BTW, not every trial allows the defendant to have center stage - if the defendant wants to speak, he's going to have to answer all the questions from the prosecution. It's not like it'll be done in Central Park.

KSM fell under the UCMJ. Can you explain how a civilian conspiring with other civilians to commit crimes against civilians should be treated through military tribunal? You might also check into GITMO; the tribunals and processes there aren't remotely swift nor fair, and there has been slipshod documentation of these cases. Further, GITMO has become an international symbol; trying KSM there gives his cause MORE recruitment fodder. Bringing him to actual American Justice restores much of our lost credibility.

makes a good point. how many mistrials or appeals will this take? how much money is going to be wasted on this garbage? Just to give him a platform for the whole world to hear his message? no security needed in guantanamo, swift and fair trial by military tribunal just makes sense

is innocent until proven guilty. It should be child's play to prove KSM guilty. Summary judgment and/or execution are used by countries NOT adhering to the rule of law - should we act like North Korea, the old USSR (or present day Russia), Saddam's Iraq, Iran, etc? No, we should act like the US of A, and be proud to do so.
