Circuit Court ruling will send plan back to Planning Commission Date published: 1/11/2006
A Stafford Circuit Court judge announced today that a subdivision plan for Crow's Nest could not be heard by the Board of Zoning Appeals before going to Planning Commission. Aquia residents Linda and Jack Fellers had asked the zoning board to review the plans for compliance with Chesapeake Bay Act requirements. But K&M Properties of McLean, developing Crow's Nest as Stafford Lakes LLC, believed the couple had no right to make that request. Waiting for the plan to be heard by that group would have delayed the company's efforts until the end of February, at least.
