Types of Auctions We Offer

a. Absolute Auctions: The word absolute is defined as being “free from restriction or limitation.” Absolute auction events are auctions when the product sells to the highest bidder regardless of price.  Since 1968, our firm has witnessed that absolute auctions increase your auction attendance and interest by at least 50% and increase your overall return by at least 25%.  We have personally sold several of our own family properties via this method.

b. Auctions with an Undisclosed Reserve Price = These are auction events in which the seller and auction firm mutually agree that the product will not sell unless and until an undisclosed reserve price is met or realized.  Quite simply, if the auction price does not meet or exceed the reserve price, the property does not sell.

c. Live Outcry Auctions = These are auction events that are held on site or at a neutral location, and are conducted by the auctioneer “calling the bid” in a traditional auction chant style.

d. Online Only Auctions = These are auctions that are totally conducted and transacted through 100% online bidding via the internet.  Typically, these are timed events where the buyer has a certain number of days or hours to competitively bid on property with a designated close time.

e. Live/Online Auctions = These are auctions where the seller and buyer can conceivably get the best of both worlds.  These auctions combine the “live outcry” method and the “online” auction method.  Buyers can choose either to show up at the auction and bid to the auctioneer “live on the lawn” or bid live real time online via the internet.  Our firm conducts these type of auctions at most of our events.

For many years Nicholls Auction Marketing Group has worked in partnership with thousands of real estate brokers and sales people.  Every year we gladly pay hundreds of thousands of dollars to Realtors who refer listings to us or who pre-register eventual buyers.  

We pay 20% of our commission to any Realtor who pre-registers and represents their client as the successful buyer.  There are strict rules and guidelines that must be followed, so please read the Broker Participation Form carefully before you fill it out.

The most lucrative service that we provide for Realtors is the referral program.  The Realtor maintains total ownership of the listing, and simply brings us in as their partner to meet the client’s goals.  Our firm takes control of the marketing juggernaut all the while keeping your name and logo front and center with ours.  The many Realtors that we have worked with over the years walk away happy and thankful, and we would love to add your name to that list!!

Absentee Bid

A procedure which allows a bidder to participate in the bidding process without being physically present. A bidder submits an offer prior to the auction.

Absolute Auction

The property sells to the highest bidder regardless of price. This typically generates a much greater interest among potential buyers resulting in greater attendance at the auction , and a higher final sale price for the item in question.


The act or process of estimating value.


Selling the property without warranties as to the condition and/or the fitness of the property for a particular use. Buyers are solely responsible for examining and judging the property for their own protection. Otherwise known as "As Is, Where Is" and "In its Present Condition.


A method of selling an item in a public forum through open and competitive bidding.


The person whom the seller engages to direct, conduct, or be responsible for a sale by auction.

Bank Letter of Credit/Guarantee

A letter from a bank certifying that a named person is worthy of a given level of credit.  Most often this is required when paying with none certified funds.


A prospective buyer’s indication or offer of a price he or she will pay to purchase an item at auction. Bids are usually in standardized increments established by the auctioneer.

Bid Assistant

A person who assists the bidder and the auctioneer. Calls out bidders’ bids, answers questions, and makes the bidder’s comfortable with the auction process

Bidder Number

Individually numbered card with your unique bidder number. This will identify you to the auctioneer as the successful bidder.

Bidder Registration

The process of registering your identity and ability to pay for successful bids. This is essential before bidding.

Broker Participation

An arrangement for third-party brokers to register potential bidders for properties being sold at auction for a commission paid by the owner of the property or the auction firm.

Buyer’s Premium

An amount (usually a percentage) that is added to the winning bid (hammer price) to determine the contract selling price which the buyer pays for the property being sold. The use of the buyer’s premium is so effective because it benefits both the buyers and the sellers.  Sellers benefit because it helps to defray many of the expenses associated with conducting an auction.  The buyer benefits because without the use of this tool, there may not have been an auction. The open and competitive bidding process might not exist if the buyer’s premium were not used to offset some of the auction related expenses.

The person employed by the principal auctioneer or auction firm to record what is sold and to whom and for what price.

Conditions of Sale

The legal terms that govern the conduct of an auction, including methods of payment, terms, buyers premiums, possession, reserves and any other announced by the auctioneer prior to the start of the auction.


The person or authorized agent or entity that consigns goods to an auctioneer. The consignor is usually the seller.

Due Diligence

The process of gathering information about the condition and legal status of assets to be sold.

Hammer Price

The highest bid which is accepted by the auctioneer

Multiple Property Auction

When selling choice, the auctioneer is offering more than one item up for auction at a time.  The winning bidder then has the choice to take one item or multiple items.  If the bidder wishes to take more than one item, the bid price will be multiplied by the amount of items the bidder chooses.

On-Site Auction

An auction conducted on the premises of the property or items being sold.

Personal Property

All goods and interests other than real property including chattels and commodities. Title for personal property sold at auction passes when the auctioneer accepts the final bid and announces the item sold (at the fall of the hammer).


Specified date and time items or real estate is available for prospective buyer viewing.

Real Property/Real Estate

Land and all interests therein, including all improvements to the land, such as buildings, fences, and fixtures. Title for real estate sold at auction passes at closing with delivery and acceptance of the deed.

Reserve Auction

The seller establishes a confidential reserve price and has the right to accept or decline the highest bid if it falls below the established reserve.  If the reserve auction method is chosen, it is imperative that the reserve price be realistic.

Sealed Bid Auctions

Each bidder submits a single, irrevocable bid without knowledge of the other bids. When the bidding period is closed, the bids are opened simultaneously, and the winner is the highest bidder.

What situations warrant using the auction method of marketing?

When the clients objectives are to sell the property in the shortest possible time frame, truly see what the market will bear under terms and conditions favorable to the seller, and desire a marketing saturation of their property then auction is the way.

Is the auction method ever used as a first selling method?

Yes, the auction method is not only the best but should be the first choice. An auction does not create the price ceiling that a conventional listing does. The seller can set the conditions for the sale and eliminate endless negotiations. . .

Are real estate auctions only for distressed properties?

No, most of our auctions do not result from repossessed properties, but rather are the result of the smart seller. A smart seller chooses the cost effective, accelerated method of selling property rather than listing the property for an undetermined length of time. Usually listings require long term marketing periods with multiple unscheduled, showings and creative, contingency offers. The auction method sets the date the property will sell and eliminates these hassles.

Can there be a reserve or a minimum bid on an item or piece of property?

Yes, the seller has the right to execute a reserve or minimum bid. This figure is discussed with the auction professional during early negotiations of the contract and is not disclosed to any potential buyer under any circumstances. The seller has the right to accept or decline the highest bid if it falls below the established reserve price.

If the high bid is less than my predetermined minimum value can I accept it?

Yes, the seller always has the right to sell the property at the highest bid price.

How long will the whole process take?

Ideally, the contract must be signed at least 3-4 weeks prior to the auction day, the closing takes place approximately 30 days after the auction date.

Where will the auction take place?

On single properties the auction typically takes place on site, either in a tent, on the front porch, or in the living room. For multi-property or vacant land auctions a ballroom setting is typically more appropriate for the auction setting.

How long after the auction occurs will I get paid?

Approximately 30 days after the auction, a closing date will be set. At that time the property owner will be paid and turnover possession to the buyer. The closing will be insured by a professional title company.  If it is a personal property auction, you will get paid on auction day.

What factors determine the success at an auction?

Many factors contribute to a successful auction, the desirability of the property being sold i.e. location, condition and surrounding properties. Secondly, and most important, realistic expectations on the part of the seller. Every property has a value, when a property is properly advertised and promoted and two or more approved bidders are in attendance the high bid achieve is true market value. If the seller realizes this and is truly motivated to sell at the achieved price under stated terms and conditions a successful auction occurs.

What are the terms of an auction?

The terms and conditions are devised to protect the seller and the process of the auction method. Properties are sold “as is, where is” with all faults. The purchase agreement is produced with no contingencies, including those for inspections and financing.

John S. Nicholls is President of Nicholls Auction Marketing Group, Inc., and oversees all day to day operations of the company. As a second generation auctioneer, licensed in 11 states and the District of Columbia, John earned a BA in Psychology and a MS in Personnel Services. In 1990, John graduated from the World Wide College of Auctioneering in Mason City, Iowa, and is currently one of the school's featured instructors. John currently conducts over 300 auctions per year for Fortune 500 companies and is a licensed realtor. Under John's leadership, Nicholls Auction was named Business of the Year by the Fredericksburg Regional Chamber of Commerce. John is an active member of the National Auctioneers Association, and currently serves as President and also holds the designations of Accredited Auctioneer of Real Estate and Auction Technology Specialist.  John also is a past President and Chairman of the Board of the Virginia Auctioneers Association. In addition, John has been a featured speaker at many state auctioneer associations throughout the country. and has had the honor to represent the auction profession on the TODAY Show, the National Association of Realtors Convention, St. Judes Children's Research Hospital, multiple news publications, and on a real estate auction consulting trip to South Africa. John is active at Spotswood Baptist Church in Fredericksburg, VA, and serves on the Boards of Virginia Community Bank, the World Automobile Auctioneers Professional Association, and the Joe Gibbs Youth for Tomorrow Foundation. Some of John's honors include the following: 1994 Virginia State Champion Auctioneer, 2003 Virginia Auctioneer of the Year, 2003 World Automobile Auctioneer Champion (Nashville, TN), 2006-07 NAA Men's Division Champion of the International Auctioneer's Championship (Orlando, FL), 2015 National Auto Auction Association's Bernie Hart Memorial Auctioneer of the Year Award, 2016 Virginia Auctioneers Association Hall of Fame Inductee, and World Wide College of Auctioneering Hall of Fame.

Charles Nicholls is the founder and chairman of the board of Nicholls Auction Marketing Group. He, along with his wife Jean, founded the company in 1968 and together they have devoted their professional lives to building a successful business. Charles graduated from the Reisch Auctioneering School (now World Wide College of Auctioneering) in Mason City, IA, in 1968. He is a member of the National Auctioneers Association and the Virginia Auctioneers Association where he has served on the Board of Directors and numerous committees. For 40 years, Charles Nicholls was the head auctioneer at the two largest auto auctions in the state of Virginia. He is a licensed realtor, a certified appraiser by C.A.G.A., and one of the first holders of the Contract Auction Specialist designation. Charles is a trustee and active member of Spotswood Baptist Church, and he is very active in the Fredericksburg community serving many non-profit organizations for 50 years. He was awarded the Bernie Hart Memorial Award by the National Automobile Auction Association in October 2004 in Nashville, TN. This award recognizes a lifetime of superior achievement, leadership, and overall professionalism in the industry. In 2006, Charles was honored by being named to the Virginia Auctioneer's Hall of Fame. Charles, a gifted teacher and mentor to many, is a true legend in the world of auctioneering.

J.T. Clark, a resident of the Richmond, VA area throughout his adult life, has been with Nicholls Auction Marketing Group since 1987. He is a 1986 graduate of the Mendenhall School of Auctioneering in High Point, NC. and is also a graduate of Mosley Flint Real Estate School. J.T. has been a member of the National Auctioneers Association for his entire career. He is a past President of the Virginia Auctioneers Association (2008). In 1988 he was awarded the titled of Virginia State Champion Auctioneer. In 2004 was the recipient of the VAA Auctioneer of the Year Award and in 2012 he received the Jake Horney Memorial Award for his service and dedication to the VAA and the auction profession.

Shields Jones, a graduate of Virginia Tech, joined Nicholls Auction Marketing Group in 1984, after being raised as a second generation auctioneer in the business. Shields is an active member of the Virginia Auctioneers Association, and is currently serving as President. After a stellar career with the Department of Agriculture in Washington, D.C., Shields currently serves as the Director of Marketing for NAMG, and works closely with the day to day operations of the company. Shields possesses an expertise in all forms of Internet and world wide web marketing, print media, public relations, visual and audio media, and various other advertising outlets. He also came to Nicholls with an expertise in antiques and glassware and also works closely with Nicholls' estate auction division. Shields also has a passion for the State 4H programs, and serves several chapters throughout Virginia.

Kelly Strauss is the Northern Neck representative for Nicholls Auction Marketing Group, and the firm's Auction Coordinator. He joined the company in 1998, after graduating from the World Wide College of Auctioneering in Mason City, IA. He served a three year term on the Board of Directors of the Virginia Auctioneer's Association, and is an active member of the National Auctioneers Association. In 2000, Kelly was awarded with the title Virginia Rookie Auctioneer of the Year. He was also awarded the 2009/10 Virginia State Champion Auctioneer. In his 25 year sales career, Kelly has attended various sales schools from Birmingham, AL to Dublin, OH. He is active in his church and community serving on the Board of Directors at the King George County YMCA, a past member of the King George County Planning Commission, the King George Chamber of Commerce and was Den Leader for the Cub Scouts. Kelly also holds certification in bi-lingual auctioneering (Spanish) from the World Wide College of Auctioneering. In addition to his love for real estate auctions, Kelly also conducts many automobile auctions for Fortune 500 Companies. He also currently serves as the seller ambassador for the prestigious Barrett-Jackson Collector Car Auctions in Scottsdale, AZ; West Palm Beach, FL; Orange County, CA; and Las Vegas, NV.

David Clark graduated in 1989 from the Mendenhall School of Auctioneering in High Point, NC, and soon thereafter developed a relationship with Nicholls Auction Marketing Group. David is a subcontract auctioneer working four (4), or more, auctions weekly for several large companies including two major US corporations. He works in the Richmond area in real estate and equipment auctions, and he is an active member in the Virginia Auctioneers Association.

Craig Damewood, a life-long resident of Loudoun County, VA, is a 1978 graduate of Reppert's School of Auctioneering in Auburn, IN. In addition to real estate expertise, Craig has an astute 30 year auction knowledge of antiques, farm and heavy equipment, and estate liquidations. Craig conducts 250+ auctions per year for Fortune 500 companies in Virginia and large corporations in Pennsylvania and West Virginia. Craig is an active member in the National Auctioneers Association and the Virginia Auctioneers Association where he served as 2004 President , 2005 Chairman of the Board, and numerous committee assignments. Some of Craig's many accomplishments include: 1999 Virginia State Champion Auctioneer, 2003 Virginia Auctioneer of the Year, and 2012 Inductee into the Virginia Auctioneer's Association Hall of Fame.

David Mast is a graduate of Nashville Auction School in Nashville, TN, and has been with Nicholls Auction Marketing Group since 2006. David has extensive expertise in machinery, equipment, livestock, and real estate auctions. Before joining Nicholls, David was involved with several prominent agricultural auction firms along the East Coast, and he was a successful business owner for 20+ years. David is a licensed Realtor, and is an active member in the Virginia Auctioneers Association.

Grover A. "Tony" Wilson is a life-long resident of Orange County Virginia. Tony is a successful business person in the region and has been for over 28 years. In the spring of 2008, Tony was named “Business Person of the Year” by the Orange County Chamber of Commerce. Tony has an extensive background in marketing, management and sales, including completion of the “Management Success” Training School in Glendale, California. He is a graduate of the Pleasants School of Auctioneering.  Tony is a member of the Virginia Auctioneers Association and the National Auctioneers Association and currently sets on the board of directors at the state level. Tony holds the following NAA designations CES (Certified Estate Specialist), AARE (Accredited Auctioneer, Real Estate), and ATS (Auction Technology Specialist) and is a licensed realtor.  Tony is very active in community service related activities, and is a life member at his local volunteer fire department where he has held various offices to include Captain and President.  He also serves on the board of the Orange County Chamber of Commerce, and the Orange County Economic Development Authority. He has been a president of the Virginia Auto Recyclers Association as well as the Orange Business Exchange.

Bill Harlowe brings a storied auction career to the NAMG team. Bill has been a powerful force in the auction community in the Charlottesville and Central Virginia area for over 40 years. Bill was the founder and CEO of the highly respected and successful Harlow-Powell Auction Ltd. Bill is a 1968 graduate of the Reisch School of Auctioneering (now World Wide College of Auctioneering), the prestigious Certified Auctioneers Institute, and the Weaver Real Estate School. An active member of the Virginia Auctioneers Association, Bill has served as President, Board of Directors member, featured seminar instructor, and was honored by being enshrined into the Virginia Auctioneers Association Hall of Fame. Bill currently conducts several auctions each week, and is an active member of the Blue Ridge Mountain Rotary Club having served as President and Board member. Bill and his lovely wife, Roberta, are lifelong residents of the Charlottesville and Fluvanna County area of Virginia, and are active members of Beaver Dam Baptist Church where Bill serves as Deacon and Bible teacher.

Chuck Harlowe is a second generation auction professional who also is a certified residential real estate appraiser. Chuck graduated from Mendenhall Auction School in 1988, and received his Bachelor's Degree from Randolph Macon College in 1992. Chuck served on the Economic Development Commission for Fluvanna County from 1998-2003, and also served our country in the United States Naval Reserves. Born and raised in the Charlottesville/Fluvanna County area, Chuck brings a wealth of real estate knowledge to the NAMG team. Chuck is a member of Calvary Chapel in Fluvanna, and enjoys coaching Upwards Basketball. Chuck and his lovely wife, Melanie reside in Fluvanna County with their two children, Anthony and Annabelle.

Jimmy Grindstaff is founder and President of Grindstaff Auction and Realty Inc. A second generation of auctioneer, he is dedicated to the auction industry. Jimmy has been in the auction industry for over 40 years. Jimmy has an impressive auction knowledge of antiques, farm & business equipment, estate liquidations, and real estate. Jimmy specializes with On-Site auctions with an emphasis on antiques, real estate and liquidations. Jimmy is an active member is his church and volunteers for numerous groups and organizations. He is an active member of National Auctioneer Association and Virginia Auctioneers Association. Anne Grindstaff is Vice President and director of Grindstaff Auction and Realty Inc. and oversee all day to day operations. After her studies at VCU, she graduated from Mosley Flint Real Estate School and has been in the real estate business for 20+ years. Anne has attended various sales schools throughout the east coast. She is a 2003 graduate of Mendenhall School of Auctioneers in High Point NC. Anne is an active member in her church, and volunteers for numerous non-profit groups and organizations. Anne holds the designation of CES (Certified Estate Specialist), ATS (Auction Technology Specialist), and is currently pursuing the esteemed Certified Auctioneers Institute (CAI) designation. Anne is an active member of National Auctioneers Association and Virginia Auctioneers Association.

Sid Smyth is a lifelong resident of South Central Virginia living in Lunenburg County. He has been a full time real estate Broker since 1999. In 2008, Sid received his Master’s Degree in business from Virginia Commonwealth University with a concentration in real estate valuation, finance and development. Sid graduated from the East Coast School of Auctioneering in 2003, and he is currently enrolled in the Certified Auctioneers Institute. Sid has served on various Boards over the years including 15 years on the Lunenburg County Board of Supervisors, member of the regional planning district board, and currently is a member of the Crossroads Community Service Board. Sid is active with the Boy Scouts and is a Vestryman for St. Paul’s and St. Andrew’s Episcopal Church. Sid has an office in Victoria, VA, where he represents Nicholls Auction Marketing Group and Long and Foster Realtors.

Tammy Dodson Reid is a lifelong resident of the Fredericksburg, Virginia area. Having lived in Fredericksburg, Stafford, Orange and Spotsylvania counties, Tammy is an established successful business person in the area and has been for over 30 years. Tammy joined Nicholls Auction Marketing Group in 2014 with a diversified background in sales and marketing. She has received various awards throughout her professional career, such as Fredericksburg Area Builders Association “Associate of the Year” (two time recipient) , “Rookie of the Year”, and “Committee Chairman of the Year” to name a few. Tammy and her husband John currently reside in Spotsylvania County.  Together they are very active in the community serving at their church, in the Spotsylvania County Partner in Education program, members of various local organizations such as Fredericksburg Area Builders Association (Board of Directors, Associate Committee, Membership Committee & Ambassador) , Fredericksburg Area Association of Realtors, Fredericksburg Area Food Bank (Board of Directors & Volunteer) and Fredericksburg Regional Chamber of Commerce Ambassador.
